Beginning on a small black oak on the E side of the Creek on John HUGHES’ line and with said line N 20 W 170 poles to a stake thence S 50 E 130 poles to a stake thence S 40 E 97 poles to a stake and thence E to the beginning containing 75 acres it being a part of a tract of land 320 acres Granted originally to me. 16 Oct. 1811. Indenture, 3 Nov. 1800, between George LEWIS of the Co. of Greenville and State of SC and Owen OWENS of the co. of Buncombe and State of NC of the other part Witnesseth that the said George LEWIS in consideration of the sum of $170 doth grant unto the said Owen OWENS A certain tract of land in our co. of Buncombe on Pigeon river beginning on a poplar running E 320 poles to a white oak thence 160 poles to a stake thence W 320 poles to a stake thence W 320 poles to a stake thence N 160 poles to the beginning containing 320 acres. The witnesses subscribing to this deed one being dead and the other not to be found by the holder of the deed this being made to the satisfaction of the Court David CARSON said he wrote the above deed and seen it acknowledged and delivered by George LEWIS to Owen OWENS. Indenture, 4 Sep. 1812, between Felix WALKER of the Co. of Haywood and John HYDE of the same co. Witnesseth said Felix WALKER for consideration of the sum of $50 have granted unto the said John HYDE a tract of land in the said Co. of Haywood on both sides of Raven Creek. Beginning on a small branch of the Raven’s fork below the Raven’s old place running up Including a peach orchard on a spanish oak & beach thence N 100 poles to a stake thence E 80 poles to a stake thence S 100 poles to a stake & thence to the beginning containing 50 acres more or less…with all singular the right title interest property claim and demand whatsoever the said Felix WALKER has invested in and entitled to by virtue of a parcel of the land of William CATHCART sold by virtue of a deed made to the said Felix WALKER by Dan’l McDOWELL Sheriff. Indenture, 13 Sep. 1809, betwixt William HAMBY of the Co. of Haywood and Samuel SMITH of the Co. of Buncombe Witnesseth that for and in consideration of the sum of $420 paid by notes and otherwise the said William HAMBY doth by these presents sell unto the above named Samuel SMITH three certain pieces of land lying in the co. of Haywood on the W side of Pigeon River adjoining the tract of land whereon Jesse ANDERSON now lives and the sd tract whereon the said HAMBY now lives Beginning on said ANDERSON’s home corner post oak on the side of a ridge on his own line then with the same E 134 poles to a stake on a branch of said river then up the several windings of said river to a line lettered thus W. H. said ANDERSON’s corner thence with his line N 35 W 28 poles to the beginning the same containing 50 acres adjoining the above named 37 acre tract beginning on a stake in a line of a 200 acre tract formerly the property of Joseph DOBSON’s where the line of a 300 & 50 acre tract formerly the property of the said DOBSON intersects running thence with a line then of W 64 poles to a stake thence N 127 poles to a stake thence E 64 poles to a stake on the line of the 200 acre tract aforesaid and with that line to the beginning containing 50 acres more or less also one other tract containing 70 acres running along with the above named 50 acres adjoining on the N and extending out to a conditional line betweext Wm. Partition of land. John GRIFFIN by his attorney in fact James RUTHERFORD vs. Lewis SMITH persuant of an order to us directed from the worshipful the co. court of pleas & quarter session of Haywood Co. commanding us to make Division of 350 acres of land between the said John GRIFFIN & the said Lewis SMITH claiming by virtue of Deed of conveyance from Adlai OSBORNE to them the said John GRIFFIN and Lewis SMITH bearing date 22 Feb. 1810 as will more fully appear by reference had to said deed which said tract of land agreeable to the [illegible] thereof is represented by the above plat and which we have divided in the following manner to wit: No. 1. Beginning at a white oak on the point of a ridge above a cliff of rocks supposed to be AVERY’s corner then with what is supposed to be AVERY’s line a SE or SW whatever may be determined to be the course to where the same crosses RICHLAND Creek the second time thence up the middle of said Creek to the mouth of the first large branch putting [jutting] into said Creek on the NW side against an island and from thence a small watnut [walnut] tree at the mouth of said branch a straight line to a spanish named in the Grant as the be ginning then E 194 poles crossing said Creek to a stake the original corner of the Grant to said OSBORNE’s thence N 285 poles crossing the said Creek to a stake on what is supposed to be AVERY’s line and with the same S 24 E 33 poles to the beginning and No. 2. Beginning at the above named Spanish oak and runs W 90 poles to a white oak near an old Indian path the second corner named in the original Grant to said OSBORN’s thence N crossing HYETT’s Creek to a stake in AVERY’s line and then with the same S 24 degrees E to his corner and along his other line from said corner on the bluff of a small hill near a spring to where it crosses said RICHLAND Creek and from thence up the middle of said Creek on the line of No. 1 to the mouth of the above named branch and from thence along the line of No. 1 to the beginning a spanish oak and we assign by ballot Lot No. 2 to Lewis SMITH and Lot No. 1 to John GRIFFIN all which is respectfully submitted. 4 Sep. 1813. Indenture, 10 Jun. 1809, between Owen OWENS of the Co. of Haywood and Lazarus TILLY of the co. aforesaid Witnesseth that the said Owen OWENS for and in consideration of the sum of $500 hath granted unto the said Lazarus TILLEY a certain tract in the on Pigeon River on both sides of said river below the mouth of Crab Tree Creek. Beginning on a poplar on the E side of the river running E 320 poles to a white oak thence S 160 poles to a stake Thence N 160 poles crossing the river to the Beginning containing 320 acres. Witnesseth That the said Felix WALKER for and in consideration of the sum of $200 have Granted unto the said John PARKS a part of a certain tract of land in the said co. of Haywood on the N side of Socah Creek…containing as is supposed 50 acres be the same more or less being a part of a tract of land of 600 acres Granted to the said Felix WALKER by patent bearing date 18 Dec. 1801. Witnesseth that for and in consideration of the sum of $95 have sold unto the said FORD a certain parcel of land containing 73 acres more or less. State of NC, Haywood Co. Whereas the Taxes on such part of a tract of land lying on SCOTT’s Creek in the Co. aforesaid. The reported property of William CATHCART to which the Indian claim has been extinguished remain due and unpaid for the year 1809 and in consequence thereof the same is now liable to be sold, and has been duly advertised according to law & put at auction to be adjudged in part to the person offering to pay the public Co. & poor Taxes thereon with all charges for advertising the same for the smallest part thereof and Robert LOVE Senr. Robert LOVE Junr. & Dan McDOWELL all of the co. aforesaid for Henry WOOD and others has offered to pay said taxes & charges amounting to $38.87 for 15,999 acres of said tract and no person has offered to pay the sum aforesaid for a less part of said tract and whereas the said Henry WOOD has presented to me a plat with the courses & distances of that part of said tract which was purchased for him the said Henry WOOD fairly setting fourth the same. Now Know all men by these presents that I, Dan’l McDOWELL, Sheriff of the co. aforesaid hereby transfer unto the said Henry WOOD a certain part or parcel of land lying on the rock house fork including Mathew LEDBETTER’s improvement. Beginning on a hickory thence with COLDWELL’s line N 67 degrees E 48 poles to a black oak on William McCONNEL’s line thence S 8 poles to a white oak with McCONNEL’s line and E 60 poles to a stake thence S 178 poles to a stake then W 105 poles to a stake and thence to the beginning. 24 Dec. 1813. Indenture, 24 Mar. 1805, between John STROTHER of the co. of Buncombe and State of NC and Daniel McDOWELL of the co. aforesaid. Witnesseth that for and in consideration of the sum of $50 the said Daniel McDOWEL a certain parcel of land lying in the Co. aforesaid on the waters of Pigeon and E side and Joining William McDOWELL’s land and bounded as follows. Beginning on a stooping hickory in William McDOWELL’s line running thence E 294 poles to a pine on the side of a mountain thence S 84 poles to Robert CANNADAY’s corner white oak thence with his line S 28 degrees W 44 poles to a small hickory Thence W 260 poles to a stake on the river bank and down the same to said Wm. McDOWELL’s line thence N with his line to the beginning containing 200 acres more or less the same being part of a large tract of land originally Granted to David ALLISON. John STROTHER {Seal}. Witnesseth that for and in consideration of the sum of $100 have sold unto the said Daniel McDOWELL all that tract or parcel of land on both sides of Pigeon River containing 187 1/2 acres. Beginning on a white oak on the N side of a spring branch and runs S 154 poles to a white oak then W 200 poles to a black oak then N 154 poles to a stake then E to the beginning. H. BATTLE {Seal}. Witnesseth That the said Alexander COLDWELL for and in consideration of the sum of $200 have conveyed unto the said Richard MORROW 100 acres of land originally Granted by the State of NC to the sd. Alexander COLDWELL by a warrant bearing date 24 Oct. 1806. Beginning on a white oak on the W bank of a branch thence S 180 poles to a hickory on the Indian Boundary line Thence with said line S 52 1/2 E 24 poles to a stake thence E 179 poles to a stake Thence N 38 poles to a stake and thence to the beginning. 22 Jun. 1818. Know all men by these presents that I, John STILES of the Co. of Haywood for and in consideration of the sum of $200 hath sold unto my son Charles STILES a tract of land in the Co. aforesaid on both sides of SCOTT’s Creek. Beginning on a hickory on the S bank of the Creek on William STILES’ line running thence with said line S 34 poles to a white oak -thence with said line S 34 poles to a white oak thence E 240 to a hickory on Zachariah COBE’s line and with said line N to a stake on the S bank of the Creek thence down the Creek with meanders thereof to a maple forked from the root on the S bank. Thence N crossing the Creek 168 poles to a stake on James HUGHES’ line and with sd line and William STILES to the beginning containing by estimation 100 acres more or less. 16 Apr. 1813. Beginning on William STILES’ line on a white oak on the S side the Creek upon the point of a ridge opposite the upper end of an old Indian field running thence E 240 poles to a stake thence N 240 poles to a stake on Wm. Indenture, 14 Apr. 1813, between David McPETERS of the Co. of Haywood and Margaret LINER of the said co. Witnesseth That for and in consideration of the sum of $150 paid by the said Margaret LINER the receipt whereof is hereby acknowledged he the said David McPETERS doth by these presents convey unto the said Margaret LINER a parcel of land in the co. of Haywood on the branch of the Flowery Garden Creek a branch of Pigeon River and a part of the E End of a 200 acre tract of Daniel KILLIAN’s and sold by said KILLIAN to John STROTHER…beginning as follows on a small hickory the SE corner of sd. KILLIAN’s upper 200 acres tract and runs thence N 171 poles to two white oaks on a small point near a small branch and on the E side of the Garden Creek thence S 72 degrees W 63 poles crossing Garden Creek to a stake thence S 160 poles to a stake thence E to the beginning. Know all men by these presents that I, Thomas LOVE of the co. of Haywood do freely give and grant to the Trustee of the Gree Hill according and their successors in office in perpetuate all the right Title Claim or demand of me or my heirs of in or to a certain tract of land containing eight acres being in the co. of Haywood by estimation about one quarter of a mile in a SW direction from the town of Waynesville for this sale of the said According as established by law. Beginning on a white oak marked as a corner running thence N 52 degrees W 17 poles and nine tenths to a stake Thence S 38 degrees W 35 paces and eight tenths to a stake and thence to the beginnings. 6 Nov. 1811. Indenture, 14 Apr. 1813, between David McPETERS of the Co. of Haywood and Margaret LINER of the said Co. that for and in consideration of the sum of $150 paid by the said Margaret LINER the receipt whereof is hereby acknowledged he the said David McPETERS doth by these presents convey unto the sd Margaret LINER a parcel of land containing 158 and three quarters of acres more or less being in the co. aforesaid and runs E eight poles to small hickory corner to MASSES’ land and with his line E 120 poles crossing the Garden Creek to a hickory thence N 26 degrees E 180 poles to SHOOK’s thence with the same 190 poles to a stake in KILLIAN’s line and thence with crossing the sd Creek to the place of the beginning.
